Early Victory – Motion to Dismiss Granted

We are proud to announce a significant legal victory for our client, M&T Bank.

On October 15, 2025, the Superior Court of Pinal County, Arizona granted our Motion to Dismiss. Plaintiffs sued Chesapeake Holding NCI, LLC (a sister company of M&T Bank) for construction defects, thirteen years after they bought the property. M&T Bank, however, did not build the home, but took title from the developer via deed in lieu of foreclosure. The Court found that the plaintiffs’ claims were time-barred under Arizona law and further held that the complaint failed to state a claim upon which relief could be granted.
